Breath Result More Than Twice The Legal Limit – Dismissed DUI

BREATH RESULT MORE THAN TWICE (2X) THE LEGAL LIMIT, completely left the roadway, swerved continuously and ran a red light.
RESULT: THE STATE DISMISSED THE DUI
FACTS: At 1:12 a.m., South Miami PD observed the defendant traveling southbound on SW 67th Avenue when she completely left the roadway and almost collided into the Fellowship Church sign. She then failed to stop for a steady red light while making a right turn onto Sunset Drive. After turning onto SW 72nd Street, the defendant failed to maintain a lane and swerved outside of the lines. As the police officer approached the vehicle, he noticed a strong odor of an unknown alcoholic beverage, watery and bloodshot eyes. The officer also noticed that there were two open 12 oz. cans of Heineken beer in the center console directly next to the defendant. The defendant failed to perform to standard on the roadside sobriety exercises. After being transported to the South Miami Police Department station, the defendant provided a breath reading of .192 and .186.
