“In Case Number F22-XXXX, the State of Florida
is taking No Further Action. Case dismissed.”

Those were the words uttered by the State Attorney’s Office in Miami, Florida announcing the dismissal of charges against our client Ricardo.  Thankfully, this nightmare only lasted for 30 days. But sitting in the county jail for that month proved to be a dark and lonely time for our client, who was held ‘No Bond’.  See, this would be extremely difficult to go through for anyone in our client’s shoes. For our client, the father of a child who is undergoing cancer treatment, it was that much more difficult to not be home for his family.

Life in Prison

Charged with lewd and lascivious molestation of a minor (under 12), our client was facing life in prison if convicted.  The allegations were brought about by his much younger sister-in-law.  After initially investigating the case, police moved quickly to arrest and charge our client with one of the worst sex crimes an individual can be accused of committing.

We were retained shortly after the arrest and were able to get right to work in order to help the prosecutor see what was truly happening in order to right this wrong.  Danny and our team worked tirelessly to get justice for our client who was being falsely accused of what most would deem a heinous allegation. Not to mention how harshly he would be treated within the criminal justice system.

Going the extra mile

From our investigation and conversations with the family, we were better prepared to truly understand the family dynamic.  We were able to begin shedding some light on motivations, justifications and reasons for the accusation.

Piece by piece, text message by text message, social media post after social media post, the Izquierdo Law Firm team was able to start exposing the State’s case and call in to question the truth behind these allegations. Danny gathered extensive information, poring over witness statements, in order to deconstruct the allegations and show that these charges were not justified. Lastly, one piece of the story helped us find a breakthrough: the alleged victim said that the opportunity was borne out of being left alone with our client thus giving him the opportunity to allegedly do this.  The victim said she was alone with our client because our client’s wife was working for Uber the day this alleged incident occurred.  In addition to the other pieces of the story not making sense, this allowed us an opportunity to poke the biggest hole in the case thus far.  Danny and the team were able to locate our client’s wife’s Uber logs (including other ridesharing and food delivery application records) to completely disprove the victim’s allegations.

Throughout these weeks of relentless work, Danny turned over his findings to the prosecution. It was during one final meeting with the prosecutor that Danny was able piece everything together and tell our client’s story.

After this meeting the State decided not to file charges and the case was dismissed the following day. After 30 long and grueling days, our client was released from jail and was able to return to his family.
