RESULT: THE STATE DISMISSED ALL CHARGES
FACTS: The defendant and co-defendants negotiated the sale of eight (8) kilograms of cocaine for $27,000 per kilogram. Once at the arrest location, the defendant and co-defendants consummated the transaction with a confidential informant and North Miami Beach Police Department undercover detectives. The State’s discovery included video and audio surveillance of the negotiation and transaction. We were able to convince the State Attorney from the Narcotics division that our client had no involvement in the transaction and was merely present at the wrong place, at the wrong time. A few months after charging the defendant, the State dismissed all charges. The defendant, who was in Immigration proceedings in his hometown of Atlanta, Georgia, now has a much better chance of remaining in the United States and becoming a Lawful Permanent Resident.
