Driver Crashed Into A Guard Gate – Dropped DUI

DRIVER CRASHED INTO A GUARD GATE AND WAS ULTIMATELY ADMITTEED INTO BACK ON TRACK DIVERSION PROGRAM AFTER BEING DENIED AT FIRST.
RESULT: THE STATE DROPPED THE DUI
FACTS: At 3:40 a.m., while attempting to get into her apartment complex, the defendant crashed into the electronic arm of the guard gate. Security officers followed the defendant home and Homestead Police officers ultimately found her behind the wheel of her car. Suspecting that she was DUI, the defendant performed poorly roadside sobriety exercises. The defendant had red bloodshot watery eyes, a strong odor of alcoholic beverage, and claimed to only having had one drink. After arrest, she was transported to the police station where she provided a breath test result of .208 and .213. As a result of the crash the defendant was denied a referral to the Back on Track DUI diversion program. We took depositions and, after attacking the State’s case, the defendant was allowed to enter the Back on Track program. Her DUI was reduced to reckless driving and she received a withhold of adjudication and no conviction on her criminal record.
