DRIVER FOUND ASLEEP ON THE 874 EXPRESSWAY
RESULT: THE STATE DROPPED THE DUI
FACTS: At 3:25 a.m., the defendant was asleep behind the wheel of his car after pulling off to the shoulder on the 874 expressway. Miami-Dade Police woke up the defendant and immediately noticed a strong odor of an unknown alcoholic beverage coming from his breath, bloodshot eyes and slurred speech. During the Horizontal Gaze Nystagmus (HGN) test the defendant displayed involuntary jerking of his eyes prior to 45° and was constantly stopping to regain balance throughout the field sobriety exercises. The defendant was also asked to perform other roadside sobriety exercises and he failed to perform to standard. The defendant also provided a breath sample of .097 and .099, over the legal limit in Florida.
