Florida’s New Law on Boating Stops: What Changed

In May 2025, Governor Ron DeSantis signed a bill that significantly limits when Florida law enforcement can stop boaters. Under the new law, officers cannot stop

your vessel without reasonable suspicion unless it’s a designated safety checkpoint or there’s probable cause of illegal activity.

This legislation aims to protect the rights of recreational boaters, but it also has major implications for Boating Under the Influence (BUI) cases.

What Is a BUI and How Is It Charged in Florida?

A BUI (Boating Under the Influence) is similar to a DUI but happens on the water. You can be charged if you’re operating a vessel while:

  • Your blood alcohol content is 0.08% or higher, or
  • You're impaired by alcohol, drugs, or a combination

Consequences include:

  • Fines
  • Jail time
  • Suspension of boating privileges
  • Mandatory substance abuse courses

What This Law Means for You

Now that random stops are restricted:

  • Law enforcement must have a reason to board or stop your vessel
  • If you were pulled over without cause, it could strengthen your defense in a BUI case
  • Your lawyer can challenge the legality of the stop. Similar to how DUI checkpoints are challenged

Know Your Rights If You're Approached on the Water

  • You can be asked to present safety equipment or ID at checkpoints
  • You don’t have to submit to field sobriety tests voluntarily
  • If arrested, ask for a lawyer immediately
  • Don’t admit to drinking. What you say can be used against you
